Legal Debt Collection: Effectively enforcing your right to payment
From unpaid invoice to an enforceable judgment
Taking legal action: when is it inevitable?
At Ultimoo, we believe in finding solutions without court intervention. In fact, we resolve 99.5% of our collection cases through amicable recovery. However, in some instances, legal debt collection may remain the only viable option. This applies, for example, when a customer persistently refuses to pay, when communication is impossible, or when payment agreements are not honored.
End-to-end legal guidance
Should a legal trajectory become necessary, we manage the entire procedure from start to finish. You won’t have to worry about legal complexities, the extensive paperwork, or strict court deadlines.
Our support ranges from the preliminary investigation—including a Legal Scan to advise on the feasibility of recovery—to the final execution of the court judgment.
How a legal procedure works
From initial legal assessment to the execution of the judgment.
1. The Summons
We initiate the legal debt collection process by serving a summons, officially calling upon the customer to appear before the court.
2. Hearing and Judgment
The judge will hear both parties and issue a ruling. Our legal experts represent you and ensure that your debt collection case is presented professionally and convincingly.
The court then issues a judgment. This is a binding ruling in which, upon a positive outcome, the customer is ordered to pay the outstanding debt.
3. Enforcement
If the customer fails to pay voluntarily after the judgment, a bailiff is engaged to enforce the ruling, for example through the seizure of assets.
National coverage
Ultimoo intentionally chooses to partner with regional bailiff firms. In doing so, we have built a network of reliable partners providing full national coverage.
Experience has shown us that local firms are better equipped to act effectively within the regions they know best. This localized expertise significantly increases the success rate of legal proceedings.
Important: The Ex Officio Assessment
The "Ex Officio" assessment (ambtshalve toetsing) for debt collection cases is quite strict. If your file does not meet these specific legal requirements, legal proceedings cannot be initiated—even if you are legally in the right. Therefore, we perform a thorough check during the intake phase to ensure all criteria for legal action are met.
This approach prevents unforeseen disappointments and significantly increases the chances of a successful outcome.
